Texas Man Sues Debt Collector over Abusive and Deceptive Practices

Credit cards, home loans, financing a car, education expenses, and medical care. These are just some of the common reasons why Texans find themselves in debt. Owing someone money, or being “in debt”, can be extremely stressful and frustrating. You work hard, pay your bills, and try to stay on top of your financial situation. But what happens when a debt collector continues to harass you or seek payment of a debt you no longer owe? What can you do?

Texas Man Seeks Justice

For one Texas man, a debt that he believed to have been dismissed escalated beyond a misunderstanding to a lawsuit. The Texas man filed a lawsuit in January 2017 against Velocity Investments, LLC. The lawsuit alleges that Velocity violated the Fair Debt Collection Practices Act when the company sent letters and continued debt collection efforts despite the debt having been dismissed prior.

The lawsuit claims that as a result of the debt collection efforts, the plaintiff suffered distress, anxiety, and disruption of his daily routine. Velocity was reportedly notified of the plaintiff’s working with an attorney, but continued to contact him directly. They further have not responded to requests for validation of the debt. The plaintiff has asked the court for a jury trial, and seeks attorney fees, statutory damages, and other proper and just relief.

Debt Collection Practices: Bad Business

Many Texans fall on hard times or incur debt that is difficult, or even impossible, to pay back immediately. When this happens, you may find yourself communicating with a debt collector much like the man in our story. A debt collection company is supposed to work with you to resolve your debt in a reasonable way when you cannot reach a suitable arrangement directly with the entity you owe.

What often happens, unfortunately, is that debt collectors use abusive, deceptive, harassing, and often illegal methods of communicating with you and trying to collect the money that is owed. Debt collectors may call you constantly, send out letters, threaten legal action, or contact your loved ones. In many cases, these practices are illegal.
